COMPREHENSIVE PRIVACY NOTICE
“CONSORCIO ADMINISTRADOR DE HOTELES NEKIE”, S.A. DE C.V. (“THE COMPANY”), located at AV. TECNOLÓGICO 2661, FRACC. LAGOS DEL COUNTRY; ZIP CODE 63175, TEPIC, NAYARIT, provides this Comprehensive Privacy Notice so you may understand its practices regarding the handling of personal data, in compliance with the Federal Law on Protection of Personal Data Held by Private Parties (“Data Law”).
What is the purpose of this notice?
To ensure the proper, controlled, and lawful use of personal data handled for administrative processes at Hotel Nekié. The personal data collected from you will be used to maintain a secure and reliable database of our clients and suppliers, optimize resources, streamline accounting control when issuing invoices, provide better service, and maintain ongoing contact to inform you of updates such as price lists, payment method changes, bank account additions or removals, and any other matters arising from our business relationship.
Your information is required for internal hotel processes. It may be obtained through registration forms, phone reservations, quotes, agreements, satisfaction surveys, comments, complaints, and/or suggestions.
Personal data collected:
- Full name (First name, paternal and maternal surnames)
- Guest’s signature
- Home phone and mobile phone
- Credit or debit card details
- Email address
- Place of origin
- Tax ID (RFC)
This information will be used for:
- Guest stay security
- Reservation processing
- Tax receipts
- Promotional information from the company
- Creating a client database
- Improving control and subsequent service processes
Security and protection of your personal data
The safeguarding of personal data is the responsibility of THE COMPANY, which will take necessary measures to prevent loss and/or theft of information stored in physical and digital files.
We commit not to transfer your personal information to third parties without your consent, except for the exceptions provided in Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties, and to carry out such transfers under the terms set by that law.
Exceptions under Article 37:
- When the transfer is provided for in a law or treaty to which Mexico is a party
- When necessary for medical prevention, diagnosis, healthcare provision, medical treatment, or health service management
- When made to controlling companies, subsidiaries, or affiliates under common control, or to a parent company or any company in the same group operating under the same internal processes and policies
- When necessary due to a contract entered into or to be entered into in the interest of the data subject, by the controller and a third party
- When required or legally demanded to safeguard public interest or for justice administration
- When necessary for the recognition, exercise, or defense of a right in a judicial process
- When necessary for maintaining or fulfilling a legal relationship between the controller and the data subject
If you do not express opposition to the transfer of your personal data under these exceptions, it will be understood that you have given your consent.
Sensitive personal data
In addition to the personal data mentioned above, Hotel Nekié may use the following sensitive personal data for the purposes outlined in this notice: current and future health status, emergency contact information, religious, philosophical, and moral beliefs, and union affiliation. The processing of this sensitive data is intended to fulfill obligations arising from the legal relationship with the data subject. We commit to treating this data under security measures that guarantee its confidentiality.
How can you access, rectify, cancel, or oppose the use of your personal data?
You have the right to know what personal data we hold about you, how we use it, and the conditions of its use (Access). You also have the right to request correction if your data is outdated, inaccurate, or incomplete (Rectification); to have it deleted from our records or databases if you believe it is not being used in accordance with legal principles, duties, and obligations (Cancellation); and to oppose its use for specific purposes (Opposition). These rights are known as ARCO rights.
You may also revoke your consent at any time and limit the use or disclosure of your data. However, please note that in some cases we may not be able to fulfill your request immediately due to legal obligations requiring continued data processing.
Procedure and requirements to exercise these rights:
- Send your request directly to the responsible party via email or in person. The request must include:
- Your name and email address for response
- A document proving your identity
- A clear and precise description of the personal data and the ARCO right you wish to exercise
- The responsible party will respond within a maximum of 15 days from receipt of your request, and the response will be sent via the method indicated in your request.
